1. Overview. This website is operated by StadiumSafe ("StadiumSafe", "we", "us", or "our"). By visiting our website or purchasing from us, you engage in our Services and agree to be bound by these Terms of Service ("Terms"). These Terms apply to all users of the site, including browsers, customers, merchants, and content contributors.

Please read these Terms carefully before placing an order. If you do not agree to all of the Terms, you may not access the site or use any Services.

2. Eligibility. By using this site, you represent that you are at least the age of majority in your state of residence, or that you are the age of majority and have given us your consent to allow any of your minor dependents to use the site. You may not use our products for any illegal or unauthorized purpose.

3. Products and pricing. All product descriptions, images, and prices are subject to change without notice. We reserve the right to discontinue any product at any time. We have made every effort to display the colors and features of our products accurately, but we cannot guarantee that your computer or device's display will be perfectly accurate.

Prices are listed in US dollars (USD). We reserve the right to refuse any order. In the event of a pricing error, we will contact you with the option to confirm at the correct price or cancel.

4. Orders, payment, and acceptance. Submitting an order is an offer to purchase. We may accept or decline the order at our discretion. Acceptance occurs only when we ship the product. We accept payment through Shopify Payments, including major credit/debit cards, Apple Pay, Google Pay, Shop Pay, and PayPal where available.

5. Shipping and delivery. Orders ship from our US fulfillment partner. Domestic processing is 1–3 business days; standard delivery within the US is 3–8 business days. Canada and Mexico ship at $4 flat (5–12 business days). Risk of loss and title pass to you upon delivery to the carrier. Delivery estimates are provided in good faith but are not guaranteed.

6. Returns and refunds. We accept returns within 30 days of receipt under the conditions set forth in our Refund Policy, which is incorporated into these Terms by reference.

7. Warranty. Each StadiumSafe™ tracker is covered by a one-year limited manufacturer warranty against defects in materials and workmanship under normal use. The warranty does not cover damage from misuse, accidents, water exposure beyond the product's rated specifications, battery exhaustion past the typical 6-month lifespan, or unauthorized modifications. To initiate a warranty claim, email support@stadiumsafekids.com with your order number and a description of the issue.

8. Disclaimer. StadiumSafe products are aids for parents and are not substitutes for active adult supervision. We do not represent or warrant that the Bluetooth tracker, the companion app, or any related Services will be uninterrupted, error-free, or always available. The product operates with a Bluetooth 4.0 range of approximately 10 meters (33 feet) in open conditions and may be affected by physical obstructions, interference, battery condition, or phone settings.

THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

9. Limitation of liability. To the maximum extent permitted by law, StadiumSafe, its directors, employees, affiliates, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or in connection with the use of our products or Services, even if advised of the possibility of such damages. Our total liability for any claim arising from a purchase shall not exceed the amount you paid for the product giving rise to the claim.

10. Intellectual property. All content on this site — including text, logos, images, and the StadiumSafe™ name and trade dress — is the property of StadiumSafe or its licensors and is protected by copyright, trademark, and other applicable laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

11. User content. If you submit reviews, comments, photos, or other content to the site or our social channels, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, and display such content in connection with our business.

12. Privacy. Your use of the site is also governed by our Privacy Policy, which describes how we collect and handle your personal information.

13. Indemnification. You agree to indemnify, defend, and hold harmless StadiumSafe and its affiliates from any claim, demand, or expense arising out of your breach of these Terms or your violation of any law or third-party rights.

14. Termination. These Terms remain in effect until terminated by either you or us. You may stop using the site at any time. We may terminate or suspend access immediately, without notice, if you fail to comply with any provision of these Terms.

15. Governing law. These Terms shall be governed by and construed in accordance with the laws applicable to consumer transactions conducted through Shopify and the merchant's jurisdiction of incorporation, without regard to conflict-of-law principles. Any dispute shall be resolved in the competent courts of that jurisdiction.

16. Changes. We reserve the right to update or modify these Terms at any time. The most current version will always be posted on this page with the last updated date. Continued use of the site after changes constitutes acceptance of the revised Terms.
